Can you drill a water well inside Moore city limits?

Water well Moore starts with a city-limits question. The state rule and the City ordinance do not answer it the same way.

State rule first. OAC 785:30-13-1, domestic use of groundwater, says: “Any landowner has a right to take groundwater from land owned by him for domestic use as defined herein without a permit.” The same rule then says: “If the well is located within a municipality, the landowner may be required to obtain a municipal permit.”

OAC 785:30-13-6(b) covers a domestic well inside a city: “Municipalities have the authority to regulate and/or permit the drilling of such domestic wells within corporate municipal limits.” Subsection (a) says the Board has jurisdiction of all wells other than domestic wells within corporate municipal limits.

Moore’s Ordinance No. 1039.23 was passed and approved December 18, 2023. It amends Chapter 5, Buildings and Building Regulations. The ordinance struck the old Sec. 5-210 heading “Private Water Wells Prohibited” and marked that section “Reserved.” The contents list shows “Sec 5-210 Private Water Wells Prohibited” struck through. The removed text began: “It is unlawful and an offense for any person to drill a well for the production of water upon property not owned and controlled by the city.” The rest of that old section was struck with it. This page says only that the ordinance removed that text and marked the section Reserved.

We could not confirm whether another part of Moore’s code, zoning, or utility rules covers private wells today, so call Moore Inspections at 405-793-5051 before you hire a driller.
